2. Purpose and scope

These general terms and conditions (the "Terms") apply to any order placed by a client (the "Client") with Immoenergy, whether acting as a consumer or as a professional.

Placing an order implies the unconditional acceptance of these Terms, which prevail over any conflicting terms of the Client.

3. Services

Immoenergy offers certification, compliance check and advisory services in the field of energy and real estate in the Brussels-Capital Region, including:

• EPC certificate (Energy Performance of Buildings)
• Energy audit
• Electrical installation compliance check
• Gas installation compliance check
• Asbestos diagnosis
• Rental inventory of fixtures
• Advisory on energy renovation

4. Quotes, orders and prices

Prices shown on the website are in euros and include applicable VAT unless stated otherwise. Prices exclude any additional fees for special access conditions to the property concerned by the service.

Any order placed through the online checkout is summarised for the Client before confirmation. The order becomes final once the Client accepts these Terms.

5. Payment

Payment is made online via the available payment methods (credit card, Bancontact, etc.) or by bank transfer before the service is performed. A discount may apply for online payment under the conditions stated during checkout.

Failure to pay on time triggers, by operation of law, late-payment interest at the Belgian legal rate, without prejudice to any other action.

6. Performance of the services

Services are performed within the timeframe agreed with the Client, subject to free access to the property and to the provision of the required documents (deeds, plans, etc.).

Any rescheduling or cancellation by the Client must be communicated at least 48 hours before the intervention; otherwise a flat fee may be charged.

7. Right of withdrawal (consumers)

In accordance with the Belgian Code of Economic Law, the Client acting as a consumer has a period of fourteen (14) days to withdraw without giving any reason.

However, the Client expressly waives the right of withdrawal when requesting the performance of the service before the end of the withdrawal period, in accordance with Article VI.53 of the Code of Economic Law.

8. Liability

Immoenergy undertakes to perform its services in accordance with industry standards and applicable regulations. It cannot be held liable for the consequences of inaccurate or incomplete information provided by the Client.

Immoenergy’s liability is limited to the amount of the services invoiced, except in cases of gross negligence or wilful misconduct.

9. Complaints

Any complaint about the performance of a service must be sent in writing to Info@immoenergy.be within eight (8) days following the delivery of the report. After that period, the service is deemed accepted.

10. Force majeure

Neither party shall be held liable for any failure to perform its contractual obligations resulting from a case of force majeure as defined by Belgian case law.

11. Personal data

The processing of the Client’s personal data is governed by our Privacy Policy, accessible from the website, and complies with the General Data Protection Regulation (GDPR).

12. Intellectual property

All elements of the website (texts, images, logos, trademarks) are protected by copyright and trademark law. Any reproduction, in whole or in part, is prohibited without prior written authorisation from Immoenergy.

13. Governing law and jurisdiction

These Terms are governed by Belgian law. Any dispute regarding their interpretation or performance falls within the exclusive jurisdiction of the courts of the Brussels district, without prejudice to mandatory consumer protection rules.
